FEDERAL SAMPLE LETTER (if your child has been abused, please tell them your story)

Dear Education and Labor Committee Member;

As a constituent and parent of a special needs child, I am shocked to learn that 19 of our state governments have no regulations in place to protect my disabled child from harmful restraint and seclusion practices, and the rest of our states have loose guidelines at best.

According to a May 2009 GAO report on restraint and seclusion, not only do states have little to no laws regulating these practices in our schools, a growing number of disabled children across the country are being suffocated, assaulted, neglected, and physically and emotionally abused.

As a representative of my child’s rights, I ask you to do the following:

  • Prohibit dangerous and harmful restraint and seclusion practices in public and private schools
  • Allocate adequate funding for grant programs that provide training and technical assistance of school professionals on reducing and eliminating the use of restraint, seclusion, and aversive interventions
  • Adopt the use of positive behavioral interventions and de-escalation methods
  • Enforce oversight/monitoring in special ed classrooms and buses, and an adequate reporting system
  • Enforce stiffer penalties for first-time offenders within the school system

Our children are in urgent need of federal legislation that guides states towards protecting our disabled children in schools. Regulations are long overdue. The time for them is now. I look forward to hearing from you.
